Personal data are processed by the Data Controller and by Processors and/or Appointees, duly appointed, for the proper fulfilment of the purposes indicated herein, using IT and/or telematic tools, as well as by using security measures to guarantee the confidentiality and to prevent unauthorised access, disclosure, modification or destruction of personal data.

Legal basis of processing

The Data Controller processes the User’s personal data where one of the following conditions is in place:

  • the User has granted their consent for one or more specific purposes;
  • processing is necessary for executing a contract with the User and/or to execute pre-contractual measures;
  • processing is necessary to fulfil a legal obligation that the Data Controller is subject to;
  • processing is necessary for the performance of a task of public interest or to exercise public authority the Data Controller is vested in;
  • processing is necessary to pursue the legitimate interest of the Data Controller or of third parties.

However, it is always possible to ask the Data Controller to clarify the concrete legal basis of each processing and in particular to specify whether the processing is based on the law, required by a contract or necessary to enter into a contract.

Place

The Data are processed at the Data Controller’s operating offices and in any other places where the parties involved in processing are located. The User’s Personal Data might be transferred to a country other than that where the User is located.

Retention period

The Data Controller shall process personal data for the time required to fulfil the purposes of this information notice and however for no longer than 10 years from the termination of the contract for the purposes indicated under point 2 and no longer than 2 years for the purposes indicated under point 1.

1. Contact the User

Mailing list or newsletter (this website)

By signing up for the mailing list or newsletter, the User’s email address is automatically added to a list of contacts, to whom email messages might be sent, containing information, including marketing and promotional in nature, relating to this website. The User’s email address might also be added to this list as a result of signing up to this website or after making a purchase.

Contact form (this website)

By filling in the contact form with their data, the User consents to their use to answer requests for information, quotes, or any other type indicated by the form header.

2. Fulfilment of contractual and pre-contractual obligations

The User’s personal data collected mandatorily for execution of the contract shall be used without the need for their express consent for the fulfilment of pre-contractual and contractual obligations deriving from the relation with the User and to fulfil the obligations set forth by law, regulation, EC legislation or by the authorities and for the management of commercial relations, to the extent necessary to best perform the requested service. In the case of specific services requested by the client, QS Informatica may access directly or indirectly the data contained in the client’s IT systems.

3. Statistics

The services contained in this section allow the Data Controller to monitor and analyse the traffic data and are used to keep track of the User’s behaviour.

Google Analytics (Google Inc.)

Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google uses the Personal Data collected in order to track and analyse the use of this website, fill in reports and share them with the other services developed by Google.
Google might use the Personal Data to contextualise and customise the ads of its advertising network.

4. Customer Help desk

By filling in the Support Ticket Opening form with their Data, the User consents to their use to answer the requests for support by QS Informatica. The User will be contacted by E-mail or Telephone. In the case of specific services requested by the client, QS Informatica may access directly or indirectly the data contained in the client’s IT systems.

Personal Data collected: Name, Company, E-mail, Telephone, Product Category for which support is required, Description of the problem, Any technical annexes

5. Signing up or logging in

By signing up or logging in, the User authorises this website to identify them and grant them access to dedicated services. The User signs up by filling in the registration form and providing their personal data directly to this website.

Personal data collected: Name, Surname, User ID, Password

6. Personnel selection and recruitment

By filling in the unsolicited application form with their Data or in response to job vacancies posted on this website and by sending their curriculum vitae, the user consents to the use of the data contained therein for the aforementioned purpose. For the purposes of said processing, the Data Controller may become aware of particular categories of personal data such as: racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, data relating to the person’s health or sexual life or sexual orientation, if contained in the curriculum vitae uploaded by the user. The processing of personal data for these particular categories is carried out in compliance with art. 9 of the GDPR.

User’s Rights

The User has the right to ask the data controller to gain access to their personal data, to rectify, erase them or restrict their processing; they have the right to object to their processing as well as the right to request their portability.

Requests can be sent by e-mail, fax or registered letter, with the subject line “Request by the data subject”, specifying in the request the right that the data subject wishes to exercise (erasure, rectification, portability, right to be forgotten), together with a valid e-mail/certified email (PEC) address to which the reply can be sent. The Data Controller or any of their appointees shall fulfil the request within 30 days of the date of receipt. Should the request be complex, the time required might be extended by a further 30 days, subject to prompt notice to the data subject.

Should the User deem it appropriate to enforce their rights, they are entitled to file a complaint with the competent control authority, namely the National Privacy Authority, located in Palazzo Monte Citorio 121, Rome.
